Owning Class 3 Items:

Silencer, Short Barrel or Fully Automatic

Legality: if you can legally own a firearm in Texas, then you can also legally purchase and own Class 3, or NFA items (National Firearms Act- 1934 mandatory excise tax & registration on weapons like machine guns, short barrrel rifles and devices like silencers) ...assuming the required paperwork is filed & approved by the BATF.

Payment is Required in Full- at the time of sale for all Class 3 items. *We accept cash, check, credit cards or can perform financing (with approved credit) for all Class 3 items. Sorry, layaway is not available on Class 3 transactions.

Class 3 Sales are Non- Refundable- or transferable once the paperwork has been submitted.

Class 3 Items Must be Retrieved- within 120- days after the BATF approves the transfer

Federal Fees (�tax stamp�):

payable directly to the BATF at time of application

$200- this is a one-time fee for Class 3 items including silencers, short barrel rifles, short barrel shotguns, machine guns or destructive devices.

$5- this is a one-time transfer fee for all Class 3 items classified as AOW (Any Other Weapon). These include pen guns, smooth bore handguns and wallet holsters that are capable of being fired from the holster.

Federal Registration Requirements:

1. Individual- registering a Class 3 item under your personal name requires fingerprints & the signature of a CLEO (Chief Law Enforcement Officer) where you live. By registering the Class 3 weapon or device as an individual, you will be the only one allowed to possess the NFA item.

2. Trust- registering a Class 3 item to a trust DOES NOT require fingerprinting, the signature of a CLEO or the sole possession requirement like filing as an individual. In fact, anyone listed as a grantor or trustee may be possess the Class 3 item. Moreover, a revocable trust can be changed at any time without having to notify the ATF. This allows multiple family members to be in legal possession of the Class 3 item.

3. Corporation- as with a trust, registering the Class 3 item to a corporation DOES NOT require fingerprinting or the signature of a CLEO. However, ONLY officers of the corporation may be in legal possession of the Class 3 item. Furthermore, this type of registration requires that your corporation be kept in good standing.

Registering Class 3 as an Individual:

here are the ATF application requirements-

Must Submit 2 Copies of the Form 4- Champion Firearms will complete these documents for you at the time of sale. Then, you must have the CLEO sign both copies of the Form 4.

Must Submit (2) Sets of Fingerprints- Champion Firearms will take your fingerprints at the time of sale.

Must Submit (2) Sets of Passport Photos- Champion Firearms will take your pictures with a passport photo camera at the time of sale.

Finally- Must include a $200 check made payable to the BATF in your application packet.

Registering Class 3 as a Trust:

here are the ATF application requirements-

*Special Note- trust must already be established prior to sale of the Class 3 item. Please refer to �Setting Up a Revocable Living Trust� below.

Must Submit 2 Copies of the Form 4- Champion Firearms will complete these documents for you at the time of sale.

Must Submit Declaration of Trust

Must Submit Updated Schedule A

Finally- Must include a $200 check made payable to the BATF in your application packet.

Setting Up a Revocable Living Trust :

here is a summary of the two options available-

Use an Attorney- this is the safest option. We highly recommend using Christopher M. Quicken Willmaker- Even if the ATF initially approves the transfer, but then later determines your Quicken trust is invalid, possession of the Class 3 item would therefore be considered illegal. As such, we cannot recommend using software to set up your trust without at least having an attorney review it first. But, we also acknowledge that thousands have used programs like this to establish a trust as a means to legally obtain Class 3 items.

After BATF Approves Your Transfer:

here are the federal Class 3 requirements-

Individual- 4473 Form must be completed at the time of transfer. However, no subsequent FBI NICS background check is required.

Trust or Corporation- both 4473 Form & FBI NICS background check required at the time of transfer.
